1. Scope of Application

These Terms and Conditions (“Terms”) govern all contracts and services offered via www.understanding-japan.com, including the sale of digital learning content, memberships, and coaching sessions.
By purchasing or accessing any product on this site, you agree to these Terms.

3. Services

Understanding Japan provides intercultural training and consulting services in the field of Japanese–European business collaboration.
Our offerings include both digital and live formats, specifically:

  • Academy Programs (Basic / Pro / Executive): self-paced eLearning modules hosted on the Tutor LMS platform, optionally combined with live Q&A or coaching sessions.
  • Consulting & Coaching: 1:1 or group sessions conducted online or on-site at the client’s premises.
  • Corporate Programs (Workshops, Team Sprints, Seminars): customized in-company training formats, delivered virtually or face-to-face in Germany, Switzerland, or other agreed locations.

Digital content is provided via secure online access. Live workshops and coaching sessions are scheduled individually according to client agreements.


4. Conclusion of Contract

A binding contract is established when you complete the checkout process and receive a confirmation email from us.
Access to digital content is granted immediately after payment (for single purchases) or upon activation of your subscription.


5. Prices and Payment

All prices are listed in euros (EUR) and include VAT where applicable.
Payments are processed securely via Stripe.
Access to paid content is conditional upon successful payment.

For recurring subscriptions, the payment interval (monthly or annual) is displayed before purchase.
Invoices or receipts are provided automatically via Stripe or on request by email.


6. Subscription Duration and Termination

Subscriptions are billed automatically according to the selected plan (monthly or annually).
You may cancel your subscription at any time via your account settings or by emailing info@understanding-japan.com.
Cancellations take effect at the end of the current billing period.
Partial refunds for unused periods are not granted.


7. Digital Content and Access

Access to eLearning modules is provided digitally via the Tutor LMS platform.
Such access is personal, non-transferable, and limited to the duration of your subscription or course access period.
Sharing login credentials or redistributing course materials is prohibited.
For live sessions or in-person trainings, participation rights are limited to the registered participants as agreed in the respective booking or corporate contract.


8. Right of Withdrawal (EU Customers)

As the content provided is digital and accessible immediately after purchase, your right of withdrawal expires once access has been granted and the download or stream has started.
By confirming your purchase, you expressly agree to this waiver in accordance with Section 356 (5) of the German Civil Code (BGB).


9. Intellectual Property

All texts, videos, graphics, and learning materials are protected by copyright.
They may not be copied, reproduced, or shared without prior written permission from Ulrike Fröhlich.


10. Liability

We are liable for damages only in cases of intent or gross negligence.
Liability for slight negligence is limited to foreseeable, typical damages.
Liability for loss of data or indirect damages is excluded.


11. Technical Requirements

Users are responsible for maintaining an internet connection and suitable devices for accessing online content.
Temporary unavailability due to maintenance or updates does not constitute a claim for refund.


12. Data Protection

The processing of personal data is governed by our Privacy Policy.


13. Governing Law and Jurisdiction

These Terms are governed by German law.
For business clients, the place of jurisdiction is Lörrach, Germany.
Mandatory consumer protection laws of your country remain unaffected.

15. Cancellation, Rescheduling and Travel Terms

15.1 Live Coaching, Workshops and Corporate Trainings

For all live services (including in-person workshops, online sessions, and corporate programs), the following cancellation and rescheduling terms apply:

  • Cancellations by the client must be submitted in writing (email is sufficient).
    • Up to 14 days before the agreed date: free of charge.
    • Between 14 and 7 days before the agreed date: 50 % of the agreed fee will be charged.
    • Less than 7 days before the agreed date or in case of no-show: 100 % of the agreed fee is due.
  • Rescheduling is possible free of charge up to 7 days before the scheduled date, subject to availability. After this period, rescheduling is treated as a cancellation.
  • If the session is part of a Corporate Program or multi-day workshop, cancellations or date changes apply to the full package unless otherwise agreed in writing.

15.2 Travel Costs

For on-site services, travel and accommodation expenses (if applicable) are billed separately according to the agreed travel plan.
Travel time may be invoiced at 50 % of the regular hourly rate, unless otherwise specified in the offer.

15.3 Cancellations by the Provider

If the trainer must cancel due to illness or force majeure (e.g., travel restrictions, technical failure), the client will be offered an alternative date.
In such cases, no further compensation or liability claims shall apply.
